1. Overview of the Application Procedure Requirements for the Construction of a PV Plant According to Current Legislation

6.1. PV Plants up to 500 kW

For PV plants up to 500 kW, the following steps must be initiated:

  • Submission of the application to the competent authority.
  • Obtaining the negative certificate regarding the non-requirement of carrying out the EPO procedure (Certificate of Exemption). This procedure must be carried out at the competent Region (Peripherie
    ).
  • Obtaining the so-called “small” Building Permit, i.e., the permit for carrying out small-scale construction activities. This permit must be obtained from the competent building authority. By way of exception, a full Building Permit may also be required if the modules to be used (especially for certain tracker systems) no longer comply with the relevant building regulations for the small building permit.
  • Obtaining the grid connection offer from the competent local office of the electricity authority DEI.
  • Signing the grid connection contract with the DEI.
  • Signing the contract for the sale of electrical energy with the DESMIE.

6.2. PV Plants with a Capacity from 500 kWp up to 1,000 kWp

For PV plants with a capacity from 500 kWp up to 1,000 kWp, the following applies:

  • Obtaining the Production License. The procedure for this must be carried out at the competent Regulatory Authority RAE, where the application must also be submitted.
  • Obtaining the Installation Permit. This procedure must be managed by the competent Region (Peripherie). Within this framework, the EPO Permit, including all relevant permits from various other authorities (for example, Forest Office, Agricultural Directorate, Authority for Archaeological Treasures, etc.), must also be obtained.
  • Obtaining the so-called “small” Building Permit, i.e., the permit for carrying out small-scale construction activities. This permit must be obtained from the competent building authority. By way of exception, a full Building Permit may also be required if the modules to be used (especially for certain tracker systems) no longer comply with the relevant building regulations for the small building permit.
  • Obtaining the grid connection offer from the competent local office of the electricity authority DEI.
  • Signing the grid connection contract with the DEI.
  • Signing the contract for the sale of electrical energy with the DESMIE.
  • Obtaining the Operating Permit from the competent Region (Peripherie).
