Generally, enforcement costs (lawyer’s fees where necessary, bailiff’s fees and expenses, and other costs such as those of the land registry and the notary) are recoverable. The amount depends on the scope, value in dispute, measures taken, and outcome, and is often quantifiable only as the proceedings progress.
Indicative bailiff fees (per Ministerial Decision No. 2/54638/0022; FEK B 1716/26.08.2008):
A) Service of documents
- Serving of document and drafting a (single‑page) service report: EUR 23
- Any additional pages: EUR 2 per page
- Annexed document: EUR 10
- Distance allowance (where applicable): EUR 0.50 plus transport costs (for the bailiff and witness where necessary)
B) Attachment (seizure)
Based on the amount of the enforcement:
- up to EUR 590.00: EUR 53
- EUR 590.01–6,500.00: plus 2.5%
- above EUR 6,500.01: 1%, capped at EUR 422
If multiple assets (e.g., real estate, ships, aircraft) are seized within the same report, the fee applies per asset.
C) Judicial auction
For drawing up an auction program (initial or repeated) and a seizure report (initial or repeated):
- up to EUR 590.00: EUR 53
- EUR 590.01–6,500.00: plus 2.0%
- above EUR 6,500.01: 1%, capped at EUR 210
Additional costs include remuneration of auction bodies (notaries, etc.), witnesses, and other bailiff actions, assessed case‑by‑case. Depending on the complexity of the case, separate bailiff fees arrangements may be made, but cannot be shifted to the debtor beyond the statutory limits.
